Child Custody Lawyers

The presence of a child in any separation can have a profound impact on their development and emotional wellbeing. As Child Custody Lawyers, we take your child’s best interest into consideration and provide legal advice throughout the separation process. We give parents a platform to discuss their future arrangements with their child, which are agreed upon in accordance with the Family Law Act.

Working Towards a Peaceful Resolution

Before beginning a court application, mediation sessions must be attended by all parents or caregivers involved. These private and joint sessions are conducted by our professional family counsellors. They will listen to your concerns and analyse the situation to reach a satisfactory resolution for all members.

If an agreement cannot be made between each person, a Child Custody Lawyer may negotiate a more suitable arrangement. Otherwise, a court order may be made to decide the future arrangements.

What Should the Parents Consider?

As parents, you need to make many important decisions about your child’s new lifestyle and how they will spend adequate time between each caregiver. Some of the most important issues to discuss, include:

  • Where will your children live and attend school?
  • How will you and your ex-partner’s work schedule influence the time spent together, with the child/ren?
  • How will your children spend time with other relatives?
  • What arrangements will be made for birthdays, holidays, and other special occasions?
  • What will the official handover arrangements be? (Time, place, etc.)

We understand these arrangements can be difficult to prepare for. Our counsellors will be able to guide you through these issues and work towards an outcome that benefits everyone involved.

Applying for a Consent Order or Parenting Plan

A consent order is a formal agreement between both parties regarding child custody and the dividing of property. We advise you on regulations in the Family Law Act that may influences these decisions, along with being a point of contact when dealing with the courts.

While less common than a consent order, we can establish an informal Parenting Plan for you. We serve as a witness for the signing and dating of the written agreement, which is then documented for you.
